The Circulating Artefacts (CircArt) project is a groundbreaking initiative against the widespread global trade in illicit antiquities.

By registering with CircArt you can:

  • Report antiquities or an antiquities-related event
  • Request a database search or obtain an assessment of authenticity or provenance

To register, please provide the information below. The CircArt team will then be in touch via email with further information to complete the registration process.

These Terms and Conditions are dated 21 February of 2020 and shall take effect from this date.

The British Museum is the sole manager of the CircArt platform on behalf of its partners. These Terms and Conditions are intended to be read alongside the British Museum Standard Terms of Use accessible at the URL: https://www.britishmuseum.org/terms-use. Please read these Terms and Conditions carefully before entering the CircArt platform at the URL: https://www.britishmuseum.org/our-work/departments/egypt-and-sudan/circulating-artefacts/registration-form ("the Platform” as use of this constitutes your acceptance of these Terms and Conditions.

The British Museum may, from time to time, modify these Terms and Conditions, and such modifications shall be effective immediately upon publication of such revised Terms and Conditions on the CircArt platform By signing up to the CircArt platform you are undertaking to review the Terms and Conditions every time you visit the platform in order to make yourself aware of such alterations. Your continued access or use of the CircArt platform shall be deemed to be your conclusive acceptance of the Terms and Conditions as they may be amended from time to time.

The consideration to be provided under this Agreement shall consist of the services provided by CircArt and interaction with the website.

DATA PROTECTION
The British Museum will process the personal data you provide in accordance with the British Museum Privacy Policy which can be accessed at the URL: https://www.britishmuseum.org/privacy-policy.

The British Museum will only gather and store the personal data you submit for the following purposes (the “Purposes”):

  • non-commercial Egyptological research on antiquities from Egypt and Sudan which you have submitted to the CircArt Database (“the Database”);

By providing information and uploading personal data onto the Database, you irrevocably grant the British Museum the right to use such data for the Purpose.

The British Museum will retain your personal data only for as long as is necessary to carry out the Purpose.

You have the right to withdraw your consent to the use of your personal data for the Purpose at any time by notifying CircArt@britishmuseum.org.

You understand and agree that the British Museum may from time to time disclose any of the data you provide on the Database (including your personal data) to UK law enforcement agencies where we reasonably believe that an object is illicit (or you have told us that you

believe an object is illicit) or, as required by UK or international law. In some cases this may lead to you being called to give evidence in criminal or other proceedings, by UK or international law enforcement agencies depending upon the nature of the content you upload to the Database.

Under no circumstances will your personal data be disclosed other than as outlined above without your prior consent.

CONFIDENTIALITY
Your data shall be treated in accordance with our standard Confidentiality Policies.

COPYRIGHT
You hereby assign to The British Museum with full title guarantee by way of future assignment all copyright and other similar rights for the full terms (including any extension or renewals thereof) throughout the world in respect of data provided via the Platform to hold unto the Trustees of the British Museum absolutely. Any such assignment shall include the right to sue for damages and/or other remedies in respect of any infringement.

You hereby irrevocably and unconditionally waive in favour of The British Museum any and all moral rights conferred on it by Chapter IV of Part I Copyright Designs and Patents Act 1988 for any work in which copyright or design right is vested in The British Museum.

You shall not do anything (whether by omission or commission) to affect or imperil the validity of any Intellectual Property Right obtained by the Trustees.

You undertake not to upload data onto the Database where to do so would constitute an infringement of Intellectual Property law.

Access to the Database does not include any reproduction rights.

DISCLAIMER AND LIABILITY
Please note that should you have information concerning an emergency, such as information concerning a threat to life or property, you should immediately contact law enforcement agencies directly to report your concerns. Use and submission of the Platform does not constitute notice of any illicit activity which should be reported in the usual way to law enforcement agencies.

While the British Museum shall make all reasonable efforts to ensure that the information is accurate, the British Museum cannot guarantee the accuracy and validity of the content provided and/or subsequently shared.

The British Museum will not be liable in any way for the accuracy, legality, relevance, timeliness or completeness of the content which (i) may be accessed on or via the Database and/or (iii) information derived from the content that is subsequently shared with law enforcement agencies.

The British Museum is not responsible for any consequences which may arise from anyone acting (or failing to act) on any of the content on the Database, including law enforcement agencies.

Users of the Platform undertake that all content they upload to the Database is accurate, to the best of their knowledge and belief, and uploaded in good faith.

Users of the Platform undertake that they shall not upload offensive, false, defamatory or otherwise misleading content.

No warranty of any kind, implied, expressed, or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus, is given with respect to the contents of the Database or its links to other Internet resources.

INDEMNITY
Users agree to indemnify The British Museum against all loss and damage howsoever caused resulting from their breach of this Agreement.

RELATIONSHIP
Nothing in this Agreement will create the relationship of agency or partnership or joint venture or employer and employee between you and the Trustees of the British Museum.

SEVERABILITY
The unenforceability or invalidity of any clause in this Agreement shall not render any other clause unenforceable or invalid. Any clause deemed to be unenforceable or invalid shall be regarded as removed from this Agreement to the extent of its unenforceability and invalidity while the remainder of this Agreement shall continue to have full effect.

APPLICABLE LAW
This Agreement shall be subject to English law and the non-exclusive jurisdiction of the English Courts.
